Can I refuse to take the breath test?
What many people do not know is that in Florida, people have the right to refuse breath tests.  This means that they may decline to take breath tests when asked by police officers.  However, by refusing to submit, people will automatically have their driver's licenses suspended and will face additional legal consequences if they are found guilty of DUI.

What are field sobriety tests?
Field sobriety tests are used by police to determine if people are intoxicated.  Essentially, field sobriety tests are agility based tests.  It is believed that if people are intoxicated, their coordination will be impacted and they will not be able to pass the field sobriety tests.  In the U.S., the National Highway Traffic Safety Administration has approved tests:  the horizontal gaze, the one leg stand and the walk and turn.
